Hydrodive Takes Addax to Court

Monday, August 25, 2014

Hydrodive Nigeria Ltd. is taking Addax Petroleum to court over a contract awarded out of Nigeria. Indigenous firm Hydrodive filed a suit against Addax in a Nigerian Federal High Court when Addax went against the West African country’s local content act and issued a contract to a foreign firm instead of Hydrodive.

The contract, the Okowri well on OML 126, was said to have been awarded to Ranger Offshore Inc., a diving company registered in the US.

According to the claim, it has been alleged that Ranger Offshore hurriedly incorporated a company in Nigeria named Rangers Subsea Nigeria Ltd., to serve as the vehicle for the execution of the contract.

The plaintiff is seeking an order declaring the purported award of the contract null and void as it was done in violation of the Nigerian Oil and Gas Industry Content Development Act and the Coastal and Inland Shipping (Cabotage) Act of 2003. Hydrodive is also asking the Nigerian Content Development and Monitoring Board to cancel the contract, as well as asking the court to direct the defendants to pay the cost of the suit.

The companies (Ranger Offshore and Rangers Subsea) were named as third and fourth defendants to the suit, while Addax Petroleum, Kaztec Engineering Ltd. and the Nigerian Content Development and Monitoring Board were named as first, second and fifth defendants.
